Terms of Service

These terms (“Terms”) govern your use of the TradeLink platform, including our website at tradelinkapp.co.uk and related services (the “Platform”).

The Platform is operated by TradeLink App Limited (“TradeLink”, “we”, “us”, “our”), a company registered in England and Wales under company number 16792008, with its registered office at 3 Mason Street, Bolton, BL6 5QP.

By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, please do not use the Platform. You can contact us at info@tradelinkapp.co.uk.

TradeLink is an introductory platform that helps customers find local tradespeople. We are not a party to any agreement between customers and tradespeople, we do not employ tradespeople, and we do not supply any trade services ourselves.

We take reasonable steps to verify each tradesperson's identity, qualifications and insurance before approving them on the Platform, but we do not guarantee the quality, safety or legality of the work they carry out. Customers should carry out their own checks, including requesting references and proof of relevant certifications and insurance before engaging a tradesperson.

To use the Platform you must:

• Be at least 18 years old.
• Have legal capacity to enter into a binding contract.
• Provide accurate and current information.
• If registering as a tradesperson, be legally entitled to offer the trade services in the United Kingdom.

Customers may submit job requests without creating an account. By submitting a job request, you confirm that the information you provide is accurate and that you are commissioning the work for a residential or small-commercial property you are authorised to do so on.

We will pass your job request to one or more tradespeople who we believe are a good match. The tradesperson may then contact you to discuss the work. Any agreement for the work itself is between you and the tradesperson directly.

By creating a tradesperson account, you warrant that:

• All information on your profile is accurate, up to date, and not misleading.
• You hold all qualifications, certifications, registrations and insurance required for the trade you offer (including, where applicable, Gas Safe, NICEIC, public liability and employers' liability cover).
• You will respond to matched job requests promptly and professionally.
• You will provide the services in accordance with applicable law and good trade practice.
• You will keep your account credentials confidential.

We may verify your identity, qualifications and insurance at any time, and may suspend or terminate your account if information is inaccurate, misleading, or if you act unprofessionally.

Customers use the Platform free of charge. Tradespeople pay TradeLink a commission on jobs arranged through the Platform, calculated as a percentage of the agreed job value (excluding VAT, materials and out-of-pocket expenses).

Commission is charged on a tiered basis:

Commission becomes payable once the tradesperson has accepted a job introduced through the Platform. We will issue an invoice for the commission, payable within 14 days of the invoice date. All fees are exclusive of VAT, which will be charged where applicable.

Tradespeople must not solicit customers to circumvent the Platform in order to avoid commission. Doing so is a material breach of these Terms and may result in account termination and recovery of unpaid commission.

You must not use the Platform to:

• Submit false, misleading or fraudulent information.
• Harass, abuse, threaten or discriminate against other users.
• Attempt to gain unauthorised access to any part of the Platform or related systems.
• Use automated tools to scrape content or submit bulk requests.
• Infringe the intellectual property or privacy rights of others.
• Upload content that is illegal, obscene, defamatory or harmful.
• Circumvent the Platform's commission arrangements with tradespeople.

We may remove content and suspend or terminate accounts that breach these Terms, with or without notice.

All content on the Platform (including design, code, text, graphics and trade marks) is owned by TradeLink or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, revocable licence to use the Platform for its intended purpose.

By uploading content (such as profile photos, gallery images or reviews) you grant us a non-exclusive, worldwide, royalty-free licence to use, display and distribute that content on and in connection with the Platform. You warrant that you own the content or have all necessary rights to grant this licence.

Reviews must be honest, fair, and based on genuine first-hand experience with a tradesperson. We may remove reviews that are fraudulent, abusive, defamatory or otherwise in breach of these Terms. We do not edit the substance of reviews.

Any dispute arising between a customer and a tradesperson is between those parties. We are not responsible for resolving such disputes, but we may, at our discretion, assist with informal mediation or provide relevant records.

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may modify, suspend or discontinue any part of the Platform at any time, and will give reasonable notice of material changes where possible.

You may stop using the Platform or close your account at any time. We may suspend or terminate your access if you breach these Terms, if we reasonably believe you pose a risk to other users, or where required by law. Termination does not affect any rights or obligations that have accrued before termination, including liability for unpaid commission.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.

Subject to the above, and to the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity arising out of or in connection with your use of the Platform.

Our total aggregate liability to you, whether in contract, tort (including negligence) or otherwise, shall not exceed the total commission you have paid us (if any) in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.

We may update these Terms from time to time. Where changes are material we will notify registered users by email, and the “last updated” date above will reflect the most recent revision. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the Platform is subject to the exclusive jurisdiction of the courts of England and Wales.
